Service Description

Ohio Pest Control provides professional pest management and extermination services to residential and commercial customers throughout the State of Ohio. Our services include, but are not limited to, inspection and identification of pest infestations, treatment and control of common household pests such as ants, termites, bed bugs, rodents, cockroaches, spiders, wasps, and other wildlife; preventative maintenance programs; and integrated pest management consultations. Treatment methods may include chemical applications, baiting systems, trapping, exclusion techniques, and environmentally conscious alternatives as appropriate for each situation. Service frequency, scope, and specific methodologies will be determined based on individual property assessments and mutually agreed-upon service plans. All services are performed by licensed technicians in accordance with Ohio Department of Agriculture regulations and applicable federal guidelines governing pesticide use and pest control operations.

No Guarantee or Warranty

Ohio Pest Control does not guarantee complete elimination of all pests from any treated property. Pest control results depend on numerous factors beyond our reasonable control, including but not limited to: environmental conditions, structural integrity of buildings, neighboring property conditions, weather events, seasonal pest migrations, and customer compliance with recommended sanitation and maintenance practices. While we employ professionally accepted methods and materials, no treatment can guarantee permanent prevention of future infestations. Any warranties or service guarantees, if offered, shall be limited to the specific terms, duration, and conditions expressly stated in a separate written service agreement. Ohio Pest Control expressly disclaims all implied warranties, including warranties of merchantability and fitness for a particular purpose, to the fullest extent permitted by Ohio law.

User Responsibilities

Customers bear significant responsibilities to ensure service effectiveness and safety. You must provide accurate information about pest sightings, property conditions, prior treatments, and known allergies or sensitivities of occupants or pets. You must ensure adequate access to all areas requiring treatment, including basements, attics, crawl spaces, and exterior perimeters. Prior to service, you must secure or remove pets, cover food preparation surfaces and utensils, and follow all pre-treatment instructions provided by our technicians. Children and pets must be kept away from treated areas for the duration specified by our technicians. You must not disturb bait stations, traps, or other treatment equipment. Failure to disclose relevant information, interference with treatment applications, or refusal to follow safety protocols may void any service commitments and may result in additional charges for re-treatment. You are responsible for maintaining reasonable sanitation standards and addressing structural conditions that contribute to pest problems.

Limitation of Liability

To the maximum extent permitted by applicable law, Ohio Pest Control's total liability arising from or relating to our services shall not exceed the total amount actually paid by you for the specific service giving rise to the claim. Ohio Pest Control shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to property damage, loss of use, business interruption, personal injury, emotional distress, or damages related to allergic reactions or chemical sensitivities, even if advised of the possibility of such damages. This limitation applies regardless of whether the claim arises in contract, tort, strict liability, or any other legal theory. You acknowledge that pest control treatments involve inherent risks, including potential exposure to pesticides and disturbance of pest habitats, and you voluntarily assume these risks by engaging our services. Nothing in these terms shall limit liability for gross negligence or willful misconduct.

Intellectual Property

All content, materials, and intellectual property associated with Ohio Pest Control, including but not limited to our business name, logos, service marks, trade dress, website content, technical documentation, treatment protocols, proprietary formulations, customer databases, and marketing materials, are the exclusive property of Ohio Pest Control or our licensors. These materials are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws. No license or right to use any of our intellectual property is granted by these Terms of Service or by your engagement of our services. Customers may not reproduce, distribute, modify, create derivative works from, publicly display, or otherwise exploit any of our intellectual property without prior written consent. Any feedback or suggestions you provide may be used by Ohio Pest Control without obligation or compensation.

Governing Law

These Terms of Service and any disputes arising from or relating to our services shall be governed by and construed in accordance with the laws of the State of Ohio, without regard to its conflict of law principles. Any legal action, proceeding, or dispute resolution shall be brought exclusively in the state or federal courts located in Franklin County, Ohio, and you hereby consent to the personal jurisdiction and venue of such courts. You waive any objection to this jurisdiction or venue on any basis, including forum non conveniens. The parties agree that the United Nations Convention on Contracts for the International Sale of Goods shall not apply to these terms. If any provision of these terms is held invalid or unenforceable under Ohio law, such provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall remain in full force and effect.

Changes to Terms

Ohio Pest Control reserves the right to modify, amend, or update these Terms of Service at any time and for any reason. Changes shall become effective immediately upon posting to our website or other written notification to customers. Material changes affecting ongoing service agreements will be communicated to active customers with at least thirty days' advance notice where practicable. Your continued engagement of our services following any such changes constitutes your acceptance of the revised terms. We encourage you to review these terms periodically. If you do not agree to any modified terms, you must discontinue use of our services and notify us in writing. No oral modifications or waivers of these terms shall be binding. Our failure to enforce any provision shall not constitute a waiver of that provision or any other provision.
